Consignment Agreement
The following are the terms of the Consignment Agreement. Those wishing to have their clothing sold at the event will receive a digital copy that will need to be signed prior to the exchange of any garments.
1. Introduction
This Consignment Agreement ("Agreement") is made between the Event Organizers ("EO") of Wear It Again and individuals who wish to have their garments sold (“Seller”).
2. Inspection and Selection
All clothing items submitted for consignment are subject to inspection by EO. EO reserves the right to select items deemed suitable for sale based on condition, style, and demand. Items not selected will be returned to the Seller or donated according to the Seller's prior indication.
3. Pricing and Tagging
EO will price items based on their condition and the approximate Manufacturer's Suggested Retail Price (MSRP). Seller understands that by submitting their items they are forfeiting their ability to price their items. Each item will be tagged with a unique code specific to the Seller to track sales.
4. Sale Logistics
EO will handle all logistics associated with the sale of the items, including but not limited to setup, promotion, and day-of-sale activities.
5. Consignment Fee
A consignment fee of 40% of the sale price will be deducted from the Seller’s total sales for all items sold during the event.
6. Payment Following the event
EO will reconcile all sales based on the unique tags/codes of the sold items. The total sales, less the consignment fee, will be remitted to the Seller via email transfer within five business days after the event.
7. Unsold Items
EO will organize any unsold items according to unique seller number and will contact the Seller once ready for pick-up. The Seller may choose to pick up any unsold items within five business days post-event or opt to have them donated to a designated local charity. Unsold items not picked up within this period will automatically be donated.
8. Liability for Lost or Stolen Items
While EO will make every reasonable effort to accurately record and account for all sales during the event, the Seller acknowledges that there is an inherent risk of shoplifting, loss, or misplacement of items in such settings. EO shall not be held responsible for any lost, stolen, or misplaced items. Sellers participate in the Wear It Again event at their own risk. If any items are found to have no longer be tagged, a photo will be taken of the item and shared with all Sellers for identification and ownership.
